Patient/Client Rights and Responsibilities

IBAA is committed to recognizing and protecting client rights. Through its policies and practices, IBAA demonstrates respect for each client’s need for confidentiality, privacy, security, access to protective services, resolution of concerns, and effective communication.

Each client will receive a written statement of client rights and responsibilities upon admission and at the beginning of each calendar year. Statements are also available upon request.

Client Rights

As a client and Parent/legal guardian, you have the right to:

Respect, dignity, and safe care

  • Receive considerate, respectful care that recognizes personal dignity, values, and beliefs.
  • Receive services in a safe environment and be free from abuse, neglect, exploitation, or harassment.
  • Receive emergency assistance when needed (e.g., staff will follow emergency procedures and contact the Parent/legal guardian and/or emergency services as appropriate).

Non-discrimination and access

  • Receive services without discrimination based on race, color, national origin, religion, sex (including pregnancy), age, disability, sexual orientation, gender identity, or other protected status.
  • Receive reasonable access to services within IBAA’s capacity, and receive communication in a timely manner.

Information and involvement

  • Know the names, roles, and credentials of therapy team members and supervising clinicians involved in the client’s care.
  • Participate in decisions about assessment, treatment planning, and services.
  • Caregivers may include others of their choice in decision-making and meetings. If confidential information will be shared, we may request a signed Release of Information.
  • Receive information about services, procedures, and recommendations in a way that is understandable (including an explanation of options, expected benefits, and potential risks).
  • Receive ongoing progress updates and the opportunity to ask questions and receive answers.

Treatment quality and ethical practice

  • Receive quality services using evidence-based practices and clinically appropriate procedures.
  • Have behavior support strategies implemented using positive, skill-based, and least-restrictive procedures necessary for safety and learning.
  • Review and approve Behavior Intervention Plans (BIPs) and significant treatment plan changes prior to implementation, when applicable.

Parent training and support

  • Receive training and support needed to help generalize skills and behavior strategies to home and community settings, as appropriate.

Privacy, confidentiality, and records (HIPAA)

  • Expect privacy and confidentiality of records and communications in accordance with HIPAA and applicable law.
  • Receive IBAA’s Notice of Privacy Practices and request information about how protected health information may be used and disclosed.
  • Request access to the client’s records and obtain copies as permitted by law.
  • Request amendments/corrections to records when appropriate.
  • Request restrictions on certain uses/disclosures and request confidential communications (IBAA will comply when required by law and when feasible).
  • Request an accounting of certain disclosures of protected health information, as applicable.
  • Be notified as required by law if a breach of unsecured protected health information occurs.

Consent and choice

  • Provide informed consent for services and withdraw consent for services, in writing, at any time.
  • Consent to or decline coordination of care with outside providers/schools (unless disclosure is otherwise required by law). Release of information requires Parent/legal guardian authorization.

Participation in Research: The Organization does not require clients or caregivers to participate in research as a condition of receiving services. If the Organization ever offers an optional research opportunity, participation will be completely voluntary and will require written informed consent. Declining or withdrawing from research will not affect eligibility for services or the quality of care provided.

Transitions

  • Participate in transition planning and receive discharge/transition recommendations when services end, consistent with IBAA policy and payer requirements.

Concerns and grievances

  • Submit concerns, complaints, or grievances and have them reviewed in accordance with IBAA’s Client Grievance Policy provided during enrollment.

Client/Parent Responsibilities

Clients and Parents/legal guardians are responsible for:

  • Providing accurate and up-to-date contact, emergency, custody/pick-up, and insurance information.
  • Attending scheduled sessions and meetings as outlined in the Attendance Policy (provided during enrollment) and communicating absences as soon as possible.
  • Participating in assessments, treatment planning, parent training, and skill generalization to support progress.
  • Pay applicable patient-responsibility amounts (e.g., copays, coinsurance, deductibles, and non-covered services) as outlined in the Financial Agreement provided during enrollment.
  • Treating staff, clients, and families with respect and following clinic safety procedures.
  • Informing IBAA of changes that may impact services (e.g., medical changes, medication changes, new safety concerns, school changes, or major life changes).
  • Following facility policies and procedures, including those related to illness, medication, and safety.
